5C. Privacy Policy – Patient Rights and Grievances (Ohio Medicaid)
Medicaid members have the right to file a grievance or appeal if they are dissatisfied with services received, if services are denied, or in the event of involuntary termination from services. Clients are informed of this right during their care. 5D. Marketing and Fundraising
Navita Health will not use or disclose your PHI for marketing or fundraising without your prior written authorization and will honor any request to opt out of future communications.

5E. Breach Notification
In the event of a breach of unsecured protected health information, Navita Health will notify affected individuals without unreasonable delay, consistent with the HIPAA/HITECH Breach Notification Rule.

6. Cookies & Tracking Technologies
Our website uses cookies and analytics tools to improve functionality and user experience. These tools may collect usage data, such as time on site and pages viewed. A. Introduction
Welcome to Navita Health. By accessing or using our services, including receiving SMS communications, you agree to comply with and be bound by these Terms and Conditions. If you do not agree with these terms, please do not engage with our services.


B. Consent for SMS Communication & Risk Disclosure
By providing your mobile number and signing the associated HIPAA Authorization, you consent to receive text messages from Navita Health, including communications that may contain Protected Health Information (PHI).
SMS is not a fully secure or encrypted method of communication. While Navita Health takes reasonable safeguards to protect your information, there is a risk that messages could be read by someone with access to your device or mobile carrier records.

C. Types of SMS Communications
If you have consented to receive text messages, you may receive SMS communications related to the following:

  • Appointment reminders
  • Billing notifications
  • Updates related to your care

D. Message Frequency
Message frequency may vary depending on the nature of the communication. For example, you may receive up to 4 SMS messages per week related to your appointments, billing, and care coordination.


E. Standard Messaging Disclosures

  • Messaging frequency may vary.
  • Message and data rates may apply.
  • You can opt out of receiving SMS messages at any time by texting "STOP" to the number from which you received the message.

F. Potential Fees for SMS Messaging
Standard message and data rates may apply, depending on your mobile carrier’s pricing plan. These charges may vary if the message is sent internationally.


G. Opt-In Method
You may opt in to receive SMS messages from Navita Health through the following methods:

  • Verbally, during a conversation with staff
  • By submitting Selecting “OPT IN” while scheduling an initial assessment
  • By submitting a written request to treatment@navitahealth.care

H. Opt-Out Method
Reply “STOP” at any time to discontinue SMS messages, or submit a written revocation of your HIPAA Authorization.You may also contact Navita Health directly to request removal from the messaging list.


I. HELP & Revocation of HIPAA Authorization
If you need assistance or are experiencing issues, reach out to us at treatment@navitahealth.care If you prefer not to receive SMS messages, simply decline to check the SMS consent box on our forms.

 
You may revoke your authorization to receive PHI via SMS at any time in writing. Revocation will not affect communications sent prior to processing your request.


J. Privacy
Navita Health respects your privacy. Your personal information will only be used to provide SMS communications as described in this policy. We will not share your data with third parties unless required by law or necessary for service delivery. Your phone number and SMS content will be stored and transmitted in accordance with HIPAA and other applicable laws. We do not share SMS consent or messages with third parties except as required by law or to facilitate your care under a HIPAA-compliant Business Associate Agreement (BAA).


K. Modifications
Navita Health reserves the right to update or modify these Terms and Conditions at any time. Updates will be posted on this page with a new revision date. Continued use of our services indicates your acceptance of these changes.
